Troopers Obtain “No Refusal” Warrant in Arrest of Texas Man for Fourth Offense DWI

CALCASIEU PARISH — A Texas man was arrested for fourth offense DWI and other charges Sunday morning.

On June 10, 2018, shortly after 6 a.m., a Trooper assigned to Louisiana State Police Troop D observed a vehicle being driven erratically on Louisiana Highway 108 south of I-10.  A traffic stop was initiated and upon contact with the driver, 46-year-old Luis F. Rubio of Laredo, Texas, obvious signs of impairment were observed.  Rubio was arrested and transported to Troop D for processing.

Upon arrival at Troop D, Rubio refused to provide a toxicology sample and remained uncooperative throughout the arrest process.  Details of the arrest were furnished to an on-call judge who approved a “no refusal” search warrant that allowed Troopers to obtain blood and urine samples from Rubio without his consent.

Rubio was charged with DWI fourth offense, unlawful refusal to submit to a chemical test,   improper lane usage, open alcoholic beverage container, improper lane usage, and defective windshield.  He was booked into the Calcasieu Correctional Center.
