Official Rules- Room Makeover
$5000 Room Makeover presented by the Greater Orange Area Chamber of Commerce
OFFICIAL RULES
1. PRELIMINARY INFORMATION: Entry valid with purchase of ticket for $10.00. Void where prohibited. You must be a legal resident of the U.S. and your home must be in Orange County, Texas to be qualified for makeover. You must own the home qualified for the Room Makeover Contest and must be at least 21 years of age as of June 20, 2007, to enter. Entries will be accepted as of June 21, 2007 at 8:00 a.m. No entries will be accepted after August 22, 2007.
2. TO ENTER: To enter, you may purchase a $10 ticket from a participating sponsor, the Chamber of Commerce offices, Chamber Board Member or Chamber Ambassador. Complete the form on the ticket, including you name, address of the home, telephone numbers where you may be reached, and the room you wish to enter for the makeover. You may purchase multiple tickets at $10 each. Entries that are incomplete, illegible or corrupted are void and will not be accepted. Employees of the Greater Orange Area Chamber of Commerce and Room Makeover Committee members and their immediate families (those who are living in the same household) are not eligible to purchase a ticket.
3. SELECTION OF WINNER AND ELIGIBILITY: All entrants must have purchased a $10 ticket from a participating Sponsor, a Chamber Board Member or Ambassador, or from the Chamber of Commerce Office. By purchasing a ticket, entrants agree to abide and be bound by these Official Rules and the decisions of the judges that are final and binding in all matters relating to this Contest.
On or about August 25, 2007, a public drawing will be held and a winning ticket selected at random from the drawing, Entrants are encouraged to be present at the public drawing for announcement of the winner and resulting publicity. The winning entrant will be notified by phone and/or mail and/or e-mail address provided on the winning ticket. Winner will also be required to sign an affidavit and release of publicity and liability. If winning entrant declines or cannot be reached after a reasonable effort has been exerted, after 7 days have passed form the drawing date, if he/she is found to be ineligible, if he/she cannot or does not comply with the Official Rules, such winning entrant will be disqualified and an alternate winning ticket will be drawn at random from the ticket entries. Applicants must also be of good moral character. The Greater Orange Area Chamber of Commerce, if necessary, to perform a background check and, if necessary, to sign waiver forms authorizing the release of personal and background information.
The winner, in the sole discretion of the Greater Orange Area Chamber of Commerce and its representatives, may appear live or via videotape of local broadcasts promoting the contest.
Winner and members of their household will be required to complete and sign an Affidavit of Eligibility, Acceptance of Conditions, and Waiver of Liability and Publicity Release (the “Releases”) or their prize will be considered forfeited and an alternate winner named.
Entrants agree to photography, film, record, and/or broadcasts of Room Makeover events at any time during the promotion and actual makeover period, including completion, without providing entrants of any compensation. Entrants agree to allow the Greater Orange Area Chamber of Commerce and participating Room Makeover Sponsors to use their likeness, voice, room and residence for purposes of advertisings, promotion and publicity without additional compensation.
If for any reason any winning ticket drawn does not meet any of the above eligibility requirements, an alternate ticket will be drawn and declared the winning entrant. If the potential Winner declines or cannot be reached after a reasonable effort has been made, if he/she is found ineligible, or if he/she cannot or does not comply with these Official Rules, such potential Winner will be disqualified and an alternate Winner will be selected.
By purchasing a ticket, entrants are not submitting an application of any type for employment of the Greater Orange Area Chamber of Commerce or any of its participating Sponsors.
By purchasing a ticket, entrants agree to waive any right to claim any ambiguity or error of the Official Rules, or the Competition itself, and agree to be bound by these Official Rules and by all decisions of the Greater Orange Area Chamber of Commerce and participating Sponsors whose decisions are binding and fair.
4. PRIZE: One (1) Grand Prize will be awarded consisting of the following:
Participating Sponsors of the $5000Room Makeover Contest presented by the Greater Orange Area Chamber of Commerce will come to your home and redecorate a room in your home. The style, quality, placement and all other aspects of the decoration will be selected and installed by a committee made up of some of the Participating Sponsors of the Contest, in their sole discretion, and provided to the Winner. Entrants agree that if selected as a Winner, entrant will permit The Greater Orange Area Chamber of Commerce and their participating Sponsors of the $5000 Room Makeover Contest to decorate his or her room and to have the room decorating videotaped for television, photographed for newspaper and other publicity, on or about the week of September 20, 2007, even if the entrant doesn’t like décor selected and installed by participating Sponsors of the contest. The total estimated retail value of the Grand Prize is $5000.00. This prize cannot be transferred by Winner or redeemed for cash and is valid only for the services and materials detailed above, with no substitution of prize by winners. Limit is one prize per contest. Winner must be willing and able to permit a crew from The Greater Orange Area Chamber of Commerce participating Sponsors (including professional designers), to enter his or her home to decorate their room and to film and photograph the Winner, the Winner’s family and the Winner’s home before, during, and after the decoration (the “Footage”) and agree that the Footage is owned by the Greater Orange Area Chamber of Commerce and their participating Room Makeover Sponsors and participating Media and may be broadcast by any of all of them at any time during the contest or anytime thereafter. Winner must also agree to appear with their families and household members in connection with winner’s room makeover at the sole discretion of Sponsors for promotional purposes. All Sponsors reserve the right to substitute a similar prize of equal or greater value at its sole discretion. In the event this contest is terminated before the prize is awarded, if any prize is forfeited or unclaimed, if any prize notification is undeliverable or unanswered in a timely manner, or in the event of non-compliance with any of these requirements, the prize will be forfeited and the Greater Orange Area Chamber of Commerce will randomly select from remaining eligible entries an alternate winner for all remaining prize elements. If winning Entrant declines or cannot be reached after a reasonable effort has been exerted, is he/she is found to be ineligible, or if he/she cannot or does not comply with these Official Rules, such potential Finalist will be disqualified and an alternate Winner will be selected by random drawing of other qualified entrants. The Greater Orange Area Chamber of Commerce reserves the right to make public personal information about the Winner on-air, during or following the Room Makeover.
5. DISCLAIMER: Winning Entrant assumes all liability for any injury or damages caused or claimed to be caused by his or her participation in the $5000 Room Makeover Contest for which Winner has purchased a ticket for entry and/or the acceptance and/or use of any prize, and releases the Greater Orange Area Chamber of Commerce and its participating Sponsors of the Makeover Contest, and their parent, subsidiaries, affiliates, officers, directors, family members and employees, from any such liability. The Greater Orange Area Chamber of Commerce, participating Sponsors, and its officers, directors, employees, subsidiaries and affiliates assume(s) no responsibility for any injury or damage to participants or to any other persons resulting from entering this competition. The Greater Orange Area Chamber of Commerce, participating Sponsors of the Makeover Contest, and any other party associated with these, are not responsible for any inaccurate information, errors in any promotional or marketing materials, errors in these rules, or for any human or electronic error (including but not limited to the administration of this Contest and awarding of the Prize), or for entries that are stolen, misdirected, garbled, delayed, lost, late, or damaged. Entry constitutes permission (except where prohibited by law) to us Winner’s name, city, likeness, and voice for the purposes of advertising, promotion and publicity, in all media now known or hereafter discovered, worldwide, without notice, review or approval by any winner and without additional compensation. Failure to comply with these rules may result in disqualification from this Contest.
6. Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and the Greater Orange Area Chamber of Commerce and the participating Sponsors of the Room Makeover Contest in connection with the Contest, shall be governed by, and construed in accordance with, the State of Texas, without giving any effect to any choice of law or conflict of law rules (whether the State of Texas, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Texas. All actions and proceedings arising out of or relation to this Contest shall be heard and determined in any court of competent jurisdiction sitting in the City of Orange, Texas.
7. ADDITIONAL RULES: Odds of winning depend on the number of eligible entries received. Failure to comply with these rules may result in disqualification. The Greater Orange Area Chamber of Commerce reserves the right to terminate this Contest or permanently disqualify from any part of it any person it believes has violated these rules. The failure of the Greater Orange Area Chamber of Commerce and/or any of the participating Sponsors of this $5000 Room Makeover Contest to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of the Greater Orange Area Chamber of Commerce (excepting compliance with applicable codes and regulations) or other force majeure event will not be considered a breach of these Official Rules.
8. WINNER ANNOUNCEMENT: For the name of the winner, available after about August 25, 2007, contact the Greater Orange Area Chamber of Commerce or one of the Participating Sponsors of the $5000 Room Makeover Contest.
9. This document, considered the Official Rules of the Contest, is in keeping with the standards of Official Rules adopted by other Room Makeover Contests within the U.s., and has been reviewed an approved by the Greater Orange Area Chamber of Commerce and its participating Sponsors of the $5000 Room Makeover Contest, and examined and evaluated by the Orange Offices of Tommy Gunn, Attorney at Law.
