Citizen’s appeal delayed a week by commissioners

ORANGE — A citizens request for appeals and hearing procedures relating to the enforcement of the Orange County Flood Damage Prevention Order was delayed one more week.

FEMA 44 C.F.R 60.6 et seq. provides criteria for the procedures.

Assistant County Attorney Douglas E. Manning was not present during the 2 p.m. Monday meeting.

Environmental Health & Code Compliance Department Director Joel Ardoin said Manning wanted a separate order for legality purposes.

Commissioner Pct. 4 Jody Crump asked about the wording under variances 3.02 and 3.04c.

The court tabled the item due to Manning out on vacation. The item will be on the agenda for the 2 p.m. July 1 meeting.

Sonny Stevenson, of Parkwood Land Company, asked the court to establish an appeals board to inform the community of the procedures to appeal a decision. Stevenson received a stop work order prior to July 26, 2010 to stop work on his property northeast of IH-10 and the Neches River, according to a previous article in The Orange Leader.

The court heard a request from Enterprise Liquids Pipeline, LLC to conduct a survey of the southeastern boundary of the Orange County Municipal Airport.

“We started last November and the project was set aside,” Ben Love, ROW Agent Suncoast land Service, Inc. on the behalf of Enterprise Liquids Pipeline, LLC said. “WE would like to get back on track.”

The request included two areas since acquired by the county that are outside the boundaries of the previous request.

The court approved the request.

The court also granted permission to Wood Group Mustang for field exploration of the south side of the airport. The group represents Shell Pipeline Company LP, Westward Ho Project.  The company will conduct core drilling approximately 80 feet deep and the length of the creek at the location for the purpose of geological formations at that depth and the geological make-up of the creek.
